Course Description:
An examination of the progression of a criminal case from the initial decision to charge through post-trial proceedings, including the decision to prosecute, judicial screening, bail,
discovery, pretrial motions, plea negotiations, trial, and sentencing. The principal objectives of the course are to equip students with a knowledge of the operation of the criminal justice system and to explore the ways in which lawyers fulfill the prosecutor and defense functions.
Assignments & Notices:
For the first class on Monday, May 18, 2009, please read Text pp 1-37, 73-79, and 90-95. On Tuesday we will get to Faretta v. California in the Supplement, Text materials at pp 98-102, 106-113, and 102-106, and Indiana v. Edwards and United States v. Gonzalez-Lopez in the Supplement. Depending upon our efficiency, we might get to “Effective Assistance of Counsel” in the latter part of Tuesday’s class.
