  1. At first read, J. Scalia’s dissent in U.S. v. Windsor is incomprehensible to me when considered against his agreement with Shelby County v. Holder just the previous day.

  2. Likewise in Wisconsin, where we have a constitutional amendment that defines marriage as between one man and one woman. We have a statutory status for domestic partnerships between same sex couples, but that statutory scheme makes clear that a domestic partnership is not equivalent to marriage.
