{"id":10902,"date":"2010-07-13T17:45:22","date_gmt":"2010-07-13T22:45:22","guid":{"rendered":"http:\/\/law.marquette.edu\/facultyblog\/?p=10902"},"modified":"2010-07-13T17:50:15","modified_gmt":"2010-07-13T22:50:15","slug":"seventh-circuit-revisits-the-second-amendment","status":"publish","type":"post","link":"https:\/\/law.marquette.edu\/facultyblog\/2010\/07\/seventh-circuit-revisits-the-second-amendment\/","title":{"rendered":"Seventh Circuit Revisits the Second Amendment"},"content":{"rendered":"<p><a href=\"http:\/\/law.marquette.edu\/facultyblog\/wp-content\/uploads\/2010\/07\/seventh-circuit1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-10906\" style=\"margin-left: 10px; margin-right: 10px;\" title=\"seventh circuit\" src=\"http:\/\/law.marquette.edu\/facultyblog\/wp-content\/uploads\/2010\/07\/seventh-circuit1.jpg\" alt=\"\" width=\"104\" height=\"100\" \/><\/a>Here&#8217;s another one to file under &#8220;no, we don&#8217;t want a revolution.&#8221;\u00a0 A few days ago, I <a href=\"http:\/\/law.marquette.edu\/facultyblog\/2010\/07\/11\/baby-you-can-drive-my-carr-or-maybe-not\/\">posted on a new Seventh Circuit\u00a0opinion <\/a>that seemed to adopt a minimalist reading of the Supreme Court&#8217;s recent decision in <em>Carr v. United States<\/em>.\u00a0 Over a vigorous dissent, the Seventh Circuit reaffirmed the validity of\u00a0pre-<em>Carr <\/em>decisions regarding the Sex Offender Registration and Notification Act.\u00a0 Now, the Seventh Circuit\u00a0has a new opinion that reaffirms the validity of a gun-control statute, and another\u00a0dissent accuses the court of incorrectly limiting a recent Supreme Court decision.<\/p>\n<p>Last year, I <a href=\"http:\/\/law.marquette.edu\/facultyblog\/2009\/11\/22\/seventh-circuit-criminal-case-of-the-week-a-second-amendment-blockbuster-or-maybe-not\/\">posted on the interesting\u00a0panel decision in <em>United States v. Skoien<\/em><\/a>, in which the Seventh Circuit remanded to the district court for the government to attempt to\u00a0justify 18 U.S.C. \u00a7 922(g) in the face of\u00a0the defendant&#8217;s\u00a0Second Amendment challenge.\u00a0 The panel relied heavily on the Supreme Court&#8217;s 2008 decision in <em>District of Columbia v. Heller<\/em>.\u00a0 However, the government successfully sought en banc review, and now the <a href=\"http:\/\/www.ca7.uscourts.gov\/fdocs\/docs.fwx?submit=showbr&amp;shofile=08-3770_004.pdf\">en banc court has decided simply to affirm Skoien&#8217;s conviction <\/a>without further proceedings.\u00a0 <!--more--><\/p>\n<p>To be sure, the court did not go so far as to say that \u00a7 922(g) will withstand all Second Amendment challenges, leaving open the possibility that a defendant with a cleaner record than Skoien might be able to present a successful overbreadth argument.\u00a0<\/p>\n<p>Judge Sykes nonetheless dissented, objecting to the majority&#8217;s reliance on information not supplied by the government through the adversarial process &#8212; and thus, as she sees it,\u00a0effectively relieving the government of its burden to justify the application of\u00a0a statute that burdens a fundamental constitutional right.\u00a0 This approach, she contended, &#8220;is difficult to reconcile with either the reasoning or the result in <em>Heller<\/em>&#8221; (37).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Here&#8217;s another one to file under &#8220;no, we don&#8217;t want a revolution.&#8221;\u00a0 A few days ago, I posted on a new Seventh Circuit\u00a0opinion that seemed to adopt a minimalist reading of the Supreme Court&#8217;s recent decision in Carr v.
