Every day we will share a different faculty member&#8217;s submission.\u00a0 Today&#8217;s submission is from\u00a0Professor Bruce Boyden.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><em>A new lawyer is trying his first criminal case, representing a man accused of biting another man\u2019s ear off in a bar fight.\u00a0 Eager to show off his trial skills, he begins to\u00a0cross-examine the prosecution\u2019s first witness:\u00a0the bartender on the night of the fight.<\/em><\/p>\n<p>Q. You were tending bar that night, isn\u2019t that correct?<\/p>\n<p>A. Yes I was.<\/p>\n<p>Q. And the bar was quite crowded that night, wasn&#8217;t it?<\/p>\n<p>A. Yes.<\/p>\n<p>Q. There were quite a lot of people standing in front of the bar, ordering drinks, isn\u2019t that right?<\/p>\n<p>A. Yes, that\u2019s right.<\/p>\n<p>Q. And the defendant was standing 10 to 20 feet away from the bar when the fight started, correct?<\/p>\n<p>A. Yes he was.<\/p>\n<p>Q. So there were several people between you and him?<\/p>\n<p>A. Yes, there were.<\/p>\n<p>Q. And you were quite busy serving drinks to those people, weren\u2019t you?<\/p>\n<p>A. Yes I was.<\/p>\n<p>Q. So that you weren\u2019t looking at the defendant when the fight started, were you?<\/p>\n<p>A. No I wasn\u2019t.<\/p>\n<p>Q. And in fact, you couldn\u2019t see the defendant when the fight started, could you?<\/p>\n<p>A. No, I don\u2019t think I could.<\/p>\n<p>Q. Therefore, isn\u2019t it true that you did not actually see the defendant bite the ear of the other man?<\/p>\n<p>A. Yeah, that\u2019s right. I didn&#8217;t see him bite the ear off.<\/p>\n<p><em>Proud of his cross-examining prowess, the young\u00a0lawyer smiled at the jury and asked one more question.<\/em><\/p>\n<p>Q. So why did you testify that the defendant bit the man\u2019s ear off?<\/p>\n<p>A.
