Process Course Materials"},"content":{"rendered":"<p>Despite my best intentions, I\u2019m about to break the promise I made in my <a href=\"http:\/\/prawfsblawg.blogs.com\/prawfsblawg\/2008\/10\/the-judicial--2.html\">last post<\/a> (and what better way to celebrate an election than by breaking a pre-election promise?).\u00a0 I thought about whether I could do another <a href=\"http:\/\/prawfsblawg.blogs.com\/prawfsblawg\/2008\/10\/malcolm-gladwel.html\">Malcolm Gladwell<\/a> post, based on his <a href=\"http:\/\/www.newyorker.com\/reporting\/2008\/11\/10\/081110fa_fact_gladwell\">latest piece<\/a>, but haven\u2019t quite been able to find an angle on that that I like.\u00a0 And so, it\u2019s back to the<a href=\"http:\/\/prawfsblawg.blogs.com\/prawfsblawg\/2008\/10\/the-judicial--2.html\"> judicial process<\/a>.\u00a0 <a href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=1297423\">I\u2019ve posted a \u201ctentative draft\u201d of my course materials on SSRN.<\/a>\u00a0 As I note in the abstract, these materials are a work in progress, and are surely incomplete in many important respects.\u00a0 I welcome all feedback concerning how they might be improved.<\/p>\n<p>Cross posted at <a
