{"id":19344,"date":"2013-01-14T16:24:14","date_gmt":"2013-01-14T21:24:14","guid":{"rendered":"http:\/\/law.marquette.edu\/facultyblog\/?p=19344"},"modified":"2013-01-14T16:24:14","modified_gmt":"2013-01-14T21:24:14","slug":"new-issue-of-fsr-considers-recent-developments-affecting-right-to-counsel","status":"publish","type":"post","link":"https:\/\/law.marquette.edu\/facultyblog\/2013\/01\/new-issue-of-fsr-considers-recent-developments-affecting-right-to-counsel\/","title":{"rendered":"New Issue of FSR Considers Recent Developments Affecting Right to Counsel"},"content":{"rendered":"<p>In three cases since 2010, the U.S. Supreme Court has seemingly strengthened the chronically anemic right to effective assistance of counsel. <em>Padilla v. Kentucky,<\/em> the first in the trilogy, indicated that defense lawyers must in some circumstances provide accurate information to their clients regarding the deportation consequences of a conviction. The Court then followed <em>Padilla<\/em> with decisions in <em>Lafler v. Cooper <\/em>and <em>Missouri v. Frye<\/em> that reaffirmed and clarified the right to effective assistance in plea bargaining. (See my post <a href=\"http:\/\/www.lifesentencesblog.com\/?p=5365\">here<\/a>.)<\/p>\n<p>Inspired by these decisions, <a href=\"http:\/\/law.wisc.edu\/profiles\/cklingele@wisc.edu\/\">Cecelia Klingele<\/a> and I put together an issue of the <a href=\"http:\/\/ucpressjournals.com\/journal.php?j=fsr\"><em>Federal Sentencing Reporter<\/em><\/a> devoted to recent legal developments affecting the right to counsel. The issue is now out in print.<\/p>\n<p>The issue includes commentary from several of the nation\u2019s most astute observers of criminal procedure; the contents appear after the jump.\u00a0 I do have a few extra copies on hand\u00a0and would be happy to forward them gratis to any interested readers of this blog.
