{"id":23584,"date":"2014-11-14T06:01:06","date_gmt":"2014-11-14T11:01:06","guid":{"rendered":"http:\/\/law.marquette.edu\/facultyblog\/?p=23584"},"modified":"2014-11-14T00:04:40","modified_gmt":"2014-11-14T05:04:40","slug":"peace-be-with-you-and-with-you","status":"publish","type":"post","link":"https:\/\/law.marquette.edu\/facultyblog\/2014\/11\/peace-be-with-you-and-with-you\/","title":{"rendered":"Peace Be With You \u2026 And With You?"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-23587\" src=\"http:\/\/law.marquette.edu\/facultyblog\/wp-content\/uploads\/2014\/11\/Exclamation_mark-e1415941125837.png\" alt=\"Exclamation_mark\" width=\"75\" height=\"103\" \/>Under the heading of hard bargaining tactics\u00a0gone bad (and bad lawyer advice), we can now add <a href=\"http:\/\/www.nytimes.com\/2014\/10\/02\/nyregion\/labor-dispute-leaves-professors-jobless.html\">this story<\/a>.\u00a0 When a group of eight faculty members at the General Theological Seminary in Manhattan decided to stop working in order to protest their newly hired dean and president, Rev. Kurt H. Dunkle, all purgatory broke loose. Under advice of their counsel, the faculty wrote a rather strongly worded letter outlining their demands regarding the dean.\u00a0 (See the nasty details of the dean\u2019s behavior <a href=\"http:\/\/www.nytimes.com\/2014\/10\/02\/nyregion\/labor-dispute-leaves-professors-jobless.html?_r=0\">here<\/a>.)<\/p>\n<p>Unimpressed with the tone of the letter, the Board of Trustees for the Seminary\u00a0considered\u00a0the letter, instead of the opening bid that the faculty intended, as\u00a0a\u00a0mass resignation.\u00a0 They dismissed the eight faculty members (leaving the students at the Seminary with only two instructors.) In this case,\u00a0the eight faculty members\u2019 hard bargaining tactic to have their foul-mouthed, micromanaging (in their descriptions) dean dismissed ended up focusing attention on their perceived \u201cbad\u201d behavior rather than that of their dean. <!--more--><\/p>\n<p><a href=\"http:\/\/www.nytimes.com\/2014\/11\/08\/nyregion\/new-york-seminary-bringing-back-7-professors-it-dismissed.html\">Earlier this month<\/a>, seven of the faculty members were reinstated (one of them accepted a severance package and moved on).\u00a0 And only now, (finally) the faculty and board of trustees are\u00a0using\u00a0mediation to see if their interests can be met.<\/p>\n<p>When we talk about expanding the pie, we should also be talking about shrinking the pie.\u00a0 This is a great example of just that \u2013 and woe for the unlucky students.
