one of the participants\u00a0in the ongoing State Capitol Sing-a-Long in which the participants sing songs protesting Governor Walker&#8217;s policies.\u00a0 The Court of Appeals upheld the dismissal of the citation by the Circuit Court, agreeing with the lower court\u00a0that the permitting policy instituted by the Walker Administration unconstitutionally infringes\u00a0on the First Amendment rights of individuals and small groups to engage in protests in the Capitol Building.\u00a0 The decision of the Court of Appeals can be read <a href=\"http:\/\/www.wicourts.gov\/ca\/opinion\/DisplayDocument.pdf?content=pdf&amp;seqNo=133996\">in its entirety here<\/a>.\u00a0\u00a0Today&#8217;s ruling is unsurprising.\u00a0 I argued that\u00a0an earlier version of the permitting policy was\u00a0unconstitutional\u00a0a little over three years ago, in a post on the Faculty Blog that can be <a href=\"http:\/\/law.marquette.edu\/facultyblog\/2011\/12\/03\/what-price-protest\/\">read here<\/a>.\u00a0 Reading the flimsy legal arguments put forth\u00a0by the State in defense of the policy before the Court of Appeals (and I do not use the word &#8220;flimsy&#8221; lightly), I remain baffled as to\u00a0why the Walker Administration would spend\u00a0so much time and\u00a0money in pursuing a permitting policy that\u00a0so obviously\u00a0conflicts with established First Amendment precedent.\u00a0 While\u00a0the Walker Administration typically\u00a0rushes to appeal contrary judicial rulings to the Wisconsin Supreme Court, confident of receiving a sympathetic hearing from that body,\u00a0I suggest that they think long and hard before appealing today&#8217;s ruling.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Today the Wisconsin Court of Appeals upheld the dismissal of a citation issued to\u00a0a &#8220;solidarity singer,&#8221;
