{"id":601,"date":"2008-09-18T08:29:52","date_gmt":"2008-09-18T13:29:52","guid":{"rendered":"http:\/\/law.marquette.edu\/facultyblog\/?p=601"},"modified":"2008-09-18T08:29:52","modified_gmt":"2008-09-18T13:29:52","slug":"science-explores-the-power-of-storytelling-to-persuade","status":"publish","type":"post","link":"https:\/\/law.marquette.edu\/facultyblog\/2008\/09\/science-explores-the-power-of-storytelling-to-persuade\/","title":{"rendered":"Science Explores the Power of Storytelling to Persuade"},"content":{"rendered":"<p>I read an interesting article from the Scientific American blog this morning, <em><a title=\"Secrets of Storytelling\" href=\"http:\/\/www.sciam.com\/article.cfm?id=the-secrets-of-storytelling\" target=\"_blank\">The Secrets of Storytelling: \u00a0Why We Love a Good Yarn<\/a><span style=\"normal;\">.<\/span>\u00a0\u00a0<\/em>As the article states, &#8220;Psychologists and neuroscientists have recently become fascinated by the human predilection for storytelling. Why does our brain seem to be wired to enjoy stories? And how do the emotional and cognitive effects of a narrative influence our beliefs and real-world decisions?&#8221;<\/p>\n<p>As a legal writing professor, the most interesting part of this research is the way it is confirming, with good evidence, what good litigators have long recognized: &#8220;stories have a unique power to persuade and motivate, because they appeal to our emotions and capacity for empathy.&#8221; \u00a0I try to teach my students to think about the role of narrative in their legal analysis from the beginning of their work with a legal problem. \u00a0Of course, legal arguments must be based upon the law, but the best legal arguments are the ones that find a legal backbone for an appealing story. \u00a0(We are fortunate to have on the faculty at Marquette a leading scholar who has written extensively about narrative in legal discourse, <a title=\"David Papke\" href=\"http:\/\/law.marquette.edu\/cgi-bin\/site.pl?10905&amp;userID=766\" target=\"_blank\">David Papke<\/a>.)<\/p>\n<p>If you are interested in reading more specifically what the science shows, you could start with the <a title=\"Page 4 of Science of Storytelling\" href=\"http:\/\/www.sciam.com\/article.cfm?id=the-secrets-of-storytelling&amp;page=4\" target=\"_blank\">&#8220;Happily Ever After&#8221; section of the article I am discussing<\/a>, which discusses a few recent findings. \u00a0Some law professors are studying this stuff, too. \u00a0Kathryn Stanchi from Temple University (who had a long and strong litigation practice before going into teaching) has written two good articles on the subject:\u00a0<em><a title=\"an Initial Exploration\" href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=927397\" target=\"_blank\">The Science of Persuasion: \u00a0An Initial Exploration<\/a><\/em>\u00a0and <em><a title=\"Playing with Fire\" href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=1015537&amp;rec=1&amp;srcabs=927397\" target=\"_blank\">Playing with Fire: \u00a0The Science of Confronting Adverse Material in Legal Advocacy<\/a>. \u00a0<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>I read an interesting article from the Scientific American blog this morning, The Secrets of Storytelling: \u00a0Why We Love a Good Yarn.\u00a0\u00a0As the article states, &#8220;Psychologists and neuroscientists have recently become fascinated by the human predilection for storytelling.
