{"id":634,"date":"2008-09-19T09:53:24","date_gmt":"2008-09-19T14:53:24","guid":{"rendered":"http:\/\/law.marquette.edu\/facultyblog\/?p=634"},"modified":"2008-09-19T09:53:24","modified_gmt":"2008-09-19T14:53:24","slug":"the-scope-of-irca-preemption","status":"publish","type":"post","link":"https:\/\/law.marquette.edu\/facultyblog\/2008\/09\/the-scope-of-irca-preemption\/","title":{"rendered":"The Scope of IRCA Preemption"},"content":{"rendered":"<p><a href=\"http:\/\/lawprofessors.typepad.com\/.shared\/image.html?\/photos\/uncategorized\/2008\/09\/19\/scales.gif\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/lawprofessors.typepad.com\/laborprof_blog\/images\/2008\/09\/19\/scales.gif\" border=\"0\" alt=\"Scales\" width=\"100\" height=\"99\" \/><\/a> Thanks to Ross Runkel for bringing to my attention this case from the\u00a09th Circuit concerning whether the Legal Arizona Workers Act (LAWA)\u00a0 is preempted by Immigration Reform and Control Act (IRCA).\u00a0 In <a href=\"http:\/\/caselaw.lp.findlaw.com\/data2\/circs\/9th\/0717272p.pdf\">CPLC v. Napolitano<\/a> (9th Cir 09\/17\/2008), the court examined LAWA, which allows state courts to suspend or revoke the business licenses of employers who knowingly or intentionally hire \u201cunauthorized aliens.\u201d\u00a0 As Ross explains:<\/p>\n<blockquote><p>That act also requires employers to use the federal E-Verify system (an internet-based system that allows an employer to verify an employee\u2019s work authorization status).<\/p><\/blockquote>\n<p>But:<\/p>\n<blockquote><p>The 9th Circuit rejected various facial challenges to the Act, concluding (among other things) that it is not expressly preempted by the federal Immigration Reform and Control Act (IRCA).\u00a0 In reaching that conclusion, the court determined that the Act fell within the scope of the \u201csavings clause\u201d of IRCA\u2019s express preemption provision as a \u201clicensing law.\u201d<\/p><\/blockquote>\n<p>So it seems that IRCA, like ERISA, recognizes federalism concerns by exempting certain types of state laws that have historically been in the domain of state regulation.<\/p>\n<p>Cross posted at <a href=\"http:\/\/lawprofessors.typepad.com\/laborprof_blog\/2008\/09\/the-scope-of-ir.html\">Workplace Prof Blog<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Thanks to Ross Runkel for bringing to my attention this case from the\u00a09th Circuit concerning whether the Legal Arizona Workers Act (LAWA)\u00a0 is preempted by Immigration Reform and Control Act (IRCA).\u00a0 In CPLC v.
