{"id":9609,"date":"2010-04-12T11:06:11","date_gmt":"2010-04-12T16:06:11","guid":{"rendered":"http:\/\/law.marquette.edu\/facultyblog\/?p=9609"},"modified":"2010-04-12T11:14:21","modified_gmt":"2010-04-12T16:14:21","slug":"who-will-replace-justice-stevens","status":"publish","type":"post","link":"https:\/\/law.marquette.edu\/facultyblog\/2010\/04\/who-will-replace-justice-stevens\/","title":{"rendered":"Who Will Replace Justice Stevens?"},"content":{"rendered":"<p><a href=\"http:\/\/law.marquette.edu\/facultyblog\/wp-content\/uploads\/2010\/04\/john-paul-stevens.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-9611\" title=\"john-paul-stevens\" src=\"http:\/\/law.marquette.edu\/facultyblog\/wp-content\/uploads\/2010\/04\/john-paul-stevens-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/><\/a>The legal community is still digesting the news that Supreme\u00a0Court Justice John Paul Stevens will retire at the end of this term.\u00a0 The New York Times recently ran a\u00a0profile\u00a0of Justice\u00a0Stevens consisting of the recollections of his former law clerks.\u00a0 Here is <a href=\"http:\/\/www.nytimes.com\/2010\/04\/11\/opinion\/11stevens.html\">the link<\/a>, in case you missed it.\u00a0\u00a0Justice Stevens was never considered one of the intellectual heavyweights of the Supreme Court, but I predict that we will come to miss his consistent, and\u00a0traditional (some might say quaint), view of the limited role that\u00a0the judiciary\u00a0should play in crafting the laws that we live by.<\/p>\n<p>Speaking of predictions, it is time to weigh in with your prognostications.\u00a0 Who will President Obama select to replace Justice Stevens.\u00a0 I will go first.<!--more-->\u00a0 I predict that the President\u00a0will nominate Harold Koh, currently\u00a0Legal Advisor to the State Department and former professor at the Yale Law School.\u00a0 My thinking is as follows: there is no political benefit to nominating a moderate like Merrick Garland of the D.C. Circuit because the Republicans will oppose the nominee no matter who it is.\u00a0 Therefore, President Obama might as well go as far to the left as he can with the nomination.\u00a0 But both Elena Kagan and Diane Wood have some (mostly exaggerated) association with either abortion or sexual orientation issues.\u00a0 Best to nominate a liberal who does not engender\u00a0the opposition of social conservatives.\u00a0 Harold Koh fits the bill, given his focus on national security issues, and he would be the first Asian American Justice.<\/p>\n<p>Share your own\u00a0predictions in the
