Public Legal Services in Times of Distress

While the nation is not (yet?) in an economic depression, our “worsening recession” has catastrophically affected thousands of area families across the social spectrum. For those who were desperately poor a year ago, not much has changed except perhaps for having even less reason to hope — dreams of government bailouts are duly noted. Joining the ranks of the forlorn are middle-class types who are facing foreclosures of their homes, job losses, and attendant legal problems. (Economic distress begets a host of family-related issues, to take just one example). For both the old and the newly poor, to use that term loosely, one of their many problems is how to confront complicated legal problems when they cannot afford legal counsel. In sum, this is a time of increasing demand for legal services by the very people who are least able to afford it. So what, if anything, is being done about it?

It is a point of pride for me to be involved in two institutions that are well aware of these gaps and are doing what they can with limited resources to assist: Marquette Law School and the Legal Aid Society of Milwaukee. Both the Law School and the Legal Aid Society confronted these issues long before the current downturn. Moreover, their focus has not been on criminal representation, important as it is, but on the unmet needs of indigents faced with a raft of traditionally civil legal problems. My purpose is to familiarize those who may not be aware of these efforts as well as to underscore the affinity between these institutions.

Is It Right to Teach About What Is Wrong?

Milwaukee Common Council President Willie Hines (left) has written a nice piece on values education in the Journal-Sentinel. I know that President Hines and I disagree on many things, but he is someone whose leadership I greatly respect.

In response to the Hines piece, Patrick McIlheran points out an obvious problem. Under current law, it is unclear that schools could effectively incorporate religious perspectives on morality into values education. (There is some room for schools to teach “about” religion, but, in the type of normative education that President Hines is calling for, that distinction — and the lack of clarity about just where it ought to be drawn — would probably preclude any deep inclusion of religious perspectives.)

Marquette alum Tom Foley (the blogger known as “Illusory Tenant”) can’t wait to dismiss Patrick as a “tin pot philosopher,” but he is wrong to do so for at least two reasons.

W(h)ither Newspapers—and Their Cities?

Newspapers have long been an important part of my life. Whether it was, if returning home from downtown Chicago with my mother in the 1970s, the effort to ensure that we secured for my father the “final markets” edition of that day’s Chicago Daily News (not merely the “latest markets,” I was taught to discriminate), or reading the New York Times in the 1980s while off in college and getting a broader sense of the world, or in the 1990s moving to Milwaukee and coming to know my adoptive city in part through its paper (regrettably, after it had become a one-newspaper town), newspapers have been for me, as for so many others, more than even the primary source of news. That remains the case, even if we are “reduced” at home to taking the Milwaukee Journal Sentinel and the Chicago Tribune.

Today of course the internet offers both access to far more newspapers than even an out-of-town newsstand (to use an almost anachronistic term) and a threat to their viability, it seems. I wonder what the effect of this will be on our own region.

While I have been wondering about this for a while (or at least since Doonesbury was recently removed from the Milwaukee Journal Sentinel, presumably for expense reasons), an essay in the most recent New Yorker by James Surowiecki particularly prompts this post.
