What’s Old Is New: Originalism in the Courts by Professor Christine Chabot — In recent years, the constitutional method of interpretation known as originalism has taken courts by storm. Courts have nevertheless struggled to implement originalism’s turn to constitutional history and text in a consistent and reliable fashion. This session will bring participants up to speed on basic tenets of originalism and discuss how it has been (or is about to be) applied by federal courts of appeals and the Supreme Court in recent (or pending) cases. Cases discussed will include fundamental constitutional issues ranging from separation of powers to the right to bear arms under the Second Amendment.
