The Current State of DACA: On June 18, 2020, in Department of Homeland Security v. Regents of the University of California, the U.S. Supreme Court ruled that the 2017 termination of Deferred Action for Childhood Arrivals (DACA), a federal policy, was arbitrary and capricious under the Administrative Procedure Act and that the decision to rescind the DACA policy must be vacated. In this presentation, Melissa Soberalski,  L’12, and Brigette Kutschma, L’02, will discuss the Court’s decision, what it means for both current DACA recipients and those who might be eligible to apply for the first time, and actions that attorneys can take to screen and assist this vulnerable community. Ms. Soberalski and Ms. Kutschma are attorneys at Soberalski Immigration Law.
